Federal Judge Blocks Trump’s Takeover of California National Guard in Blow to White House Power Grab

In a dramatic rebuke of Donald Trump’s aggressive power play in California, a federal judge has ordered the former president to return control of the California National Guard to Governor Gavin Newsom. The ruling, issued late Thursday by U.S. District Judge Charles Breyer in San Francisco, declares Trump’s move “likely unconstitutional” and a violation of the Tenth Amendment.

This emergency ruling follows a week of legal and political chaos after Trump deployed thousands of Guard troops and active-duty Marines to Los Angeles amid escalating protests over immigration raids. Newsom, who never authorized the federalization of his state’s Guard, immediately challenged the decision in court—arguing it was a blatant abuse of federal authority.

Judge Breyer agreed. His order mandates that all National Guard troops placed under federal command must be returned to the governor’s control by noon Friday, June 13. The court emphasized that Trump’s actions likely violated both the Posse Comitatus Act and the limits of Title 10 authority—laws designed to restrict the use of military force on U.S. soil.

Importantly, the ruling does not yet apply to the 700 Marines Trump also sent to the region. Those forces remain under federal control, though additional legal challenges may soon follow.

This is a temporary restraining order—but it sends a clear signal: executive power has limits, and the Constitution still matters.

The White House is expected to appeal.
