NO KINGS IN AMERICA: The 9th Circuit Just Told Trump to Sit the Hell Down

Let’s get one thing straight: Donald Trump didn’t win jack shit in court—even if he’s out there on Truth Social pounding his orange chest like he just conquered Normandy. The 9th Circuit may have temporarily let him keep control of the California National Guard, but they torched his real argument: that his power is beyond judicial review.

Read that again.
Trump’s entire play here was to establish unchecked presidential power—to use troops on American soil against American citizens—with zero oversight. He wanted the courts to bow down and say, “Yes sir, Mr. King, do as you wish.”

And the 9th Circuit said: Not today. Not ever.

Let’s break it down.

Trump used Title 10 of the U.S. Code, which lets the president federalize the National Guard under certain emergencies—like invasions, insurrections, or domestic unrest. But here’s the kicker: that authority is granted by Congress under Article I, not gifted from some divine golden toilet under Mar-a-Lago.

And that means the courts can review it.
And that means Trump is not above the law.
And that means we still have a Constitution, goddamnit.

The 9th Circuit wrote loud and clear:

“The source of the President’s power here is statutory, not constitutional. And statutory authority is always reviewable by the courts unless Congress clearly says otherwise.”

Translation: you don’t get a blank check just because you’re playing Civil War LARP in the West Wing.
